Illegal Activity in Strata Complex –

Not everything which occurs in a Strata Company is for the Council of the Strata Company to manage.

In most circumstances, if you have a complaint to make against your neighbours we would be able to assist you with lodging this (more information on complaints can be found here).

However, alleged illegal activity such as drug use and/or manufacturing, prostitution, violence and other 'illegal' activities should be raised directly with the relevant authority. It is usually a requirement that the person witnessing the activity makes the report.  Therefore notifying the Strata Company may be useful in order for the Strata Company to manage any insurance liability issues, and to assist in monitoring the activities.  However, the Strata Manager nor the Council of the Strata Company are usually able to submit a report to an authority unless they have witnessed, or have some proof of the activity in question.

The main points to remember when reporting incidents to the police is that a copy of the police report number is needed, this is crucial when proceeding with an insurance claim. All other documents relating to the incident need to be kept in order and accurately to assist when building the case.

Legal Responsibilities of Landlords, Property Managers and Agents

Under the Health (Miscellaneous Provisions) Act 1911, the main party usually responsible for cleaning and/or repairing a contaminated property is the owner, although some provisions may require the occupant or persons responsible for the contamination to take certain actions. Under Consumer Protection legislation, if the buyer or tenant of a property becomes ill from exposure to a known former clan lab or smoke house, and it was not disclosed as a material fact, the owner and real estate agency could be subject to legal action.

If you suspect a property is being used for illegal purposes, contact Crime Stoppers on 1800 333 000 or online.
